1. This is the second bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 97/2025 registered at Police Station Shankargarh District- Balrampur Ramanujganj (C.G.) for the offence punishable under Sections 69,
2 296, 351(2), 115(2) of Bharatiya Nyaya Sanhita.

Case of the prosecution, in brief, is that the victim lodged an FIR on 14.07.2025 alleging that the applicant had subjected her to sexual exploitation on the false promise of marriage during the period from 14.01.2021 to 06.07.2025. It is alleged that the applicant maintained a physical relationship with the victim for a prolonged period and later failed to fulfill his promise to marry her. On the basis of the said allegations, the offence was registered and investigation was conducted. Hence, the bail application.
3. Learned counsel for the applicant submits that the first bail application of the applicant was rejected by this Court on merits vide
order dated 13.10.2025 passed in MCRC No.7233 of 2025, therefore this second bail application is filed on the ground that the victim during the course of the trial has turned hostile, further the applicant is in jail since 15.07.2025, hence, he prays for releasing the applicant on regular bail.

On the other hand, learned State counsel opposes the bail application and submits that the applicant allegedly established physical relations with the victim on the pretext of marriage form 14.01.2021 to 06.07.2025 and, after exploiting her sexually for a prolonged period refused to marry her. He further submits that as per MLC Report, the victim sustained 6 injuries on various parts of her body, therefore, the applicant is not entitled for grant of bail.
5. I have heard learned counsel for the parties and perused the case diary.

From perusal of the records, it transpires that this is the second bail application of the applicant and first bail application of the applicant was rejected by this Court vide order dated 13.10.2025 in MCRC No. 7233 of 2025 on the ground that after the death of her victim’s husband, the applicant was pressurizing her to marry him and, upon her refusal, committed rape upon her and also assaulted her. The Court further noted that the victim's daughter is an eyewitness to the incident and that the MLC report corroborates the allegations by recording six contusions on different parts of the victim's body and an abrasion on her neck, further the ground raised by the applicant that victim has turned hostile, the same cannot be a ground for releasing the applicant on bail as the same amounts to only tampering with the evidence, hence, there appears to be no good ground to entertain the present second bail application.
7. Accordingly, the second bail application of the applicant-Lalsekhan Kevat, involved in Crime No. 97/2025 registered at Police Station Shankargarh District- Balrampur Ramanujganj (C.G.) for the offence punishable under Sections 69, 296, 351(2), 115(2) of BNS, is rejected at this stage.
8. Office is directed to provide a certified copy of this order to the trial Court concerned for necessary information and compliance.
