The petitioners are apprehending their arrest in connection with Kunda PS Case No.11 of 2026, for offence registered under section 18, 26(a), 28, 29, 30 of NDPS Act and Section 33 of Indian Forest Act, pending in court of learned Sessions Judge Cum Special Judge, NDPS Cases, Chatra.

Learned counsel for petitioners submits that the petitioners have been falsely implicated in this case and the allegations are made of cultivation of poppy plants in the forest land and the petitioners are poor villagers and they have got no criminal antecedent as disclosed in paragraph no.19 of the petition and the co-accused persons in identical situation has been granted anticipatory bail by this Court by way of Annexure-2 series.
4. Learned State counsel opposes prayer and submits that

allegations are there of cultivation of poppy plants in the forest land.

Considering that the land is of the forest department and the same is not belonging to the petitioners and the petitioners are said to be a villagers and the co-accused persons have been granted anticipatory bail as aforesaid and the petitioners have got no criminal antecedent as aforesaid, I am inclined to grant anticipatory bail to both the petitioners.
6. Accordingly, both the petitioners, above named, are hereby
directed to surrender before learned court within three weeks from today, and in event of their surrender/arrest, both the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of like amount each, to satisfaction of learned Sessions Judge Cum Special Judge, NDPS Cases, Chatra, in connection with Kunda PS Case No.11 of 2026, subject to the conditions as laid down under section 482(2) of Bhartiya Nagrik Suraksha Sanhita (BNSS), 2023.
