Order No. 05/ Dated 28.07.2026
Heard Mr. Gaurav, learned counsel for the appellant and learned A.P.P for the State.
This appeal is directed against the order dated 12.05.2026 passed by learned Additional Sessions Judge-I, Simdega in connection with M.C.A. No.154/2026, arising out of Simdega (AHTU) P.S. Case No.02/2024, whereby and whereunder, the prayer for bail of the appellant has been rejected.
It appears that the appellant had earlier moved for grant of bail in Cr. Appeal (DB) No.1396/2025, which however was dismissed on 24.11.2025 by a Coordinate Bench of this Court.
Submission has been advanced by the learned counsel for the appellant that there is a changed circumstance which has prompted the appellant to renew the prayer for bail of the appellant. It has further been submitted that when the prayer for bail of the appellant was earlier considered and rejected, the victim was traceless, but subsequently, the victim has been recovered and her 183 BNSS statement has also been recorded. Learned counsel further submits that the appellant is in custody since 14.06.2025.
Learned A.P.P on behalf of the State has opposed the prayer for bail of the appellant and has submitted that the victim has returned back from Delhi and her 183 BNSS statement has also been recorded. Taking into consideration the period of custody undergone by the appellant and the fact that the victim has returned back, we, while setting aside the order dated 12.05.2026 passed by learned Additional Sessions
Judge-I, Simdega in connection with M.C.A. No.154/2026, arising out of Simdega (AHTU) P.S. Case No.02/2024, direct that the appellant, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I, Simdega, in connection with M.C.A. No.154/2026, arising out of Simdega (AHTU) P.S. Case No.02/2024. This appeal is allowed. Let the instructions submitted at the bar be kept on record.
