2. The petitioner is apprehending his arrest in connection with Poraiyahat P.S. Case No.52 of 2026, for the alleged offences registered under Sections 191(2), 190, 126(2), 127(2), 115(2), 109, 121(1), 121(2), 303(2), 317(2), 351(2) and 352 of Bharatiya Nyaya Sanhita, 2023, Section 4/21 of Mines and Minerals (Development & Regulation) Act, 1957, Rule 4/54 of Jharkhand Minor Mineral Concession Rules, 2004 and under Rule 9/13 of Jharkhand Minerals (Prevention of Illegal Mining Transportation and Storage) Rule, 2017 pending in the Court of learned Sub-Divisional Judicial Magistrate, Godda.

Learned counsel appearing for the petitioner submits that inadvertently in paragraph No.7 of the petition truck has been typed in place of tractor, and in view of that he seeks permission to

correct the same.
4. Permission is accorded.

Learned counsel appearing for the petitioner submits that the petitioner happened to be driver of the said tractor and apart from that the petitioner has played no role. He further submits that in the next part of the FIR it is alleged that some of the persons have forcefully taken away one of the tractor. He then submits that the petitioner has got no role in the second part of the allegation and the said tractor is still in the custody of police. He next submits that the petitioner has got no criminal antecedent as disclosed in paragraph No.18 of the petition. On these grounds, he submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposed the prayer and submits that allegations are there of forcefully taking away one of the tractor from the custody of police.

Considering that the said tractor of which the petitioner was driver is still in the custody of police and the petitioner has got no criminal antecedent as disclosed in paragraph No.18 of the petition and so far the second part of the FIR is concerned there is nothing against the petitioner and there are general and omnibus allegation. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioner.
9. Accordingly, the petitioner, above named, is hereby directed

to surrender before the learned Court within three weeks from today, and in the event of his surrender/arrest, the petitioner, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand), with two sureties of the like amount each, to the satisfaction of learned Sub-Divisional Judicial Magistrate, Godda in connection with Poraiyahat P.S. Case No.52 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
