Learned counsel for the petitioners submits that other than the statement of a co-accused, there is no material available against the present petitioners. Charge-sheet has been submitted. The principal accused was granted bail. Learned Additional Public Prosecutor representing the State strongly opposes the prayer for anticipatory bail, relies on the case diary and submits that other than the statement of a co-accused, there is money trail and phone call conversations between the principal accused and the present petitioners. Considering the above, the other materials available in the case diary and the restrictions contained in Section 37 of 2 the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
