---- 02/28.07.2026 Heard learned counsel appearing for the petitioners as well as the learned counsel appearing for the State.
2. The petitioners are apprehending their arrest in connection with Murhu P.S. Case No. 24 of 2026, registered for the offence under Sections 189(2), 191(2), 194(2) 196(2), 299, 302, 197(2), 353(3), 115(2), 109(1), 132, 324(4) and 61(2) of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Judicial Magistrate, 1st Class, Khunti.

Learned counsel appearing for the petitioners submits that there are general and omnibus allegation against 200 – 250 persons of altercation among two groups and that has happened during the procession of Ram Navami Puja. She further submits that the petitioners are the shopkeepers. She then submits that in identical situation co- accused persons have already been granted anticipatory bail by this

Court in A.B.A. No.4040 of 2026. On these grounds, she submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposes the prayer and submits that the allegations are there of indulging in altercation and that allegations are there against two groups.

In the FIR, the allegations are made against 200 – 250 persons assembled in the procession and the altercation took place between two groups and there are general and omnibus allegation and it has been pointed out that the petitioners are the businessman of the nearby locality and in identical situation co-accused persons have already been granted anticipatory bail by this Court in the aforesaid A.B.A. In the attending facts and circumstances of this case, I am inclined to provide anticipatory bail to the petitioners.

Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Judicial Magistrate, 1st Class, Khunti in connection with Murhu P.S. Case No. 24 of 2026, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023.
