It is alleged that two groups of persons pelted stones at each other and created a ruckus. In all, 40 accused were named in the suo motu FIR. Several of the accused were granted anticipatory bail. However, the prayer for anticipatory bail of the present petitioner was rejected by the learned Sessions Judge. Learned counsel appearing on behalf of the State relies on the case diary and strongly opposes the prayer for anticipatory bail. According to the statements of witnesses, the members of the two groups not only pelted stones at each other, but also fired shots. As many as 10 empty cartridges were recovered from the locale. Subsequently, some persons were arrested and several arms were recovered. Considering the above and the other incriminating materials available in the case diary, I do not consider this is to be a fit case for granting anticipatory bail. Accordingly, the application for anticipatory bail is rejected. 2 Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
