( 2026:JHHC:22483 ) IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 7069 of 2026 ------ Deepak Sahu, aged 35 years, son of Anil Kumar Sahu, resident of Village –Dhorriti, P.O. Karaundi, P.S. and District –Gumla. … Petitioner Versus The State of Jharkhand … Opposite Party ------ CORAM: HON’BLE MR. JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Nilesh Kumar, Advocate : Ms. Priyanka Agarwal, Advocate For the State : Mr. Shree Prakash Jha, Addl. P.P. For the Informant : Mr. Madhav Prasad, Advocate ------ Order No.02 Dated- 29.07.2026 Heard the parties. The petitioner has moved this Court for grant of bail in connection with Kanke P.S. Case No.223 of 2023 registered for the offences punishable under sections 406, 420, 385, 387, 34, 120B of the IPC. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner has taken Rs.30,00,000/- for selling some land to the informant and made the informant enter into two different agreements, firstly with one person and secondly with another person for selling of the land by those persons but the persons who entered into agreement with the informant have not executed any sale deed in favour of the informant. It is further submitted that the allegations against the petitioner are all false and there is no allegation against the petitioner of deceiving the informant since the beginning of the transaction between the parties. It is next submitted that there is no allegation of dishonest misappropriation of any entrusted property. It is further submitted that the dispute between the parties is basically a civil dispute and a cloak of criminal case has been given for wreaking vengeance. It is then submitted that the petitioner has no criminal antecedent as has been mentioned in para –13 of the bail application. It is next submitted that the petitioner has been in custody since 15.06.2026, as has been mentioned in paragraph no. 12 of the bail application. It is further submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. The learned Addl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the above-named petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate -XIII, Ranchi, in connection with Kanke P.S. Case No.223 of 2023 with the condition that the petitioner will co-operate with the trial of the case and will furnish his mobile number and photocopy of the Aadhar Card with an undertaking that he will not change his mobile number during the trial of the case, with further condition that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case.
