1. The applicant-claimant by way of this application seeks appointment of an Arbitrator invoking Clause 64 of the Standard General Condition of Contract of the Work Contract Agreement/ Tender condition and notice in this respect was issued to the respondent-General Manager, West Central Railway.
2. Reply to the arbitration application has been filed and objections have been raised with regard to the limitation as well as to the total amount claimed.

3. In my considered opinion, after the decision in the case of M/s. Devender Singh Contractor Vs. Union of India in D.B. Civil Reference No.1/2024 decided on 14.11.2025, appointment of Arbitrator for deciding the disputes inter se under Section 11 (6) of the Arbitration and Conciliation Act, 1996 cannot be objected to.
4. Accordingly, with the consent of the parties, this Court directs the appointment of Hon’ble Mr. Justice Dalip Singh (Former Judge, Rajasthan High Court) E-mail:- singh.dalipkunadi@gmail.com to act as the Sole Arbitrator and to decide all issues without prejudice to the rights and contentions raised in the present application and in the reply. The arbitration fees shall be determined in accordance with the Fourth Schedule of the Act of 1996, as amended. The fee of the Arbitrator will be equally borne by both the parties.
5. The arbitration application is allowed accordingly.
6. Copy of this order be sent to the appointed Sole Arbitrator.
