For Respondent No. 3 : Ms. Sunita Jain, Advocate Hon’ble Shri Justice Rakesh Mohan Pandey Order On Board 2 18.6.2026 1) By way of this petition, the petitioner has sought following reliefs:- 10.1 It is prayed that this Hon'ble Court may kindly be pleased to call for the entire records pertaining to case of the petitioner for its kind perusal. 10.2 That, this Hon'ble Court may kindly be pleased to issue an appropriate writ directing the respondent authorities to consider the case of the petitioner at the earliest for giving the entire dues of the deceased employee i.e. husband of the petitioner and to give compassionate appointment to her in place of her husband at the earliest. 10.3 This Hon'ble Court may further kindly be pleased to issue an appropriate writ commanding the respondents to fix the proximate pension till fixation of the pension of the petitioner and to give the entire retiral dues to th petitioner including compassionate appointment to he at the earliest. 10.4 Any other relief/ relief's, which this Hon'ble Court may think fit and proper in the facts and circumstances of the case, with cost of the petition, may also be granted to the petitioner. 2) Learned counsel for the petitioner submits that petitioner is the second wife of Dinesh Chandra Rawat who was working on the post of Peon under respondent No. 3 and he died in harness on 20.10.2019. He further submits that petitioner moved an application for grant of compassionate appointment and payment of retiral dues on 25.2.2020 but respondent No. 3 directed the petitioner to submit succession certificate vide order dated 5.3.2020. He also submits that succession case is pending before the competent Court and till date same has not been decided. He prays for a direction to the respondent authorities to decide the claim of petitioner with regard to compassionate appointment and retiral dues. 3 3) On the other hand, learned counsel appearing for respondent No. 3 submits that Madhu Rawat is the legally wedded wife of deceased government servant as per the service record whereas Sawan Rawat is the adopted son and there is dispute with regard to the claim of compassionate appointment among family members therefore respondent No. 3 directed the parties to submit succession certificate. 4) Heard. 5) Admittedly, the petitioner has not disclosed the information with regard to the first wife and the adopted son of the deceased. It appears that there is dispute among the family members with regard to grant of compassionate appointment and payment of retiral dues. 6) Taking into consideration the above-discussed facts, petitioner and the other interested parties are directed to approach the respondent No. 3 with relevant documents including succession certificate. Respondent No. 3 is also directed to take appropriate decision expeditiously strictly in accordance with the law. 7) With the aforesaid direction(s), this petition stands disposed.
