Side) PETITION FOR ANTICIPATORY BAIL Under Sec.482 of BNSS PRAYER :- For Anticipatory Bail in Cr.No. 133 of 2026 on the file of the respondent police. ORDER : The Court made the following order :- The petitioners/A1 to A7, who apprehend arrest at the hands of the respondent for the offences punishable under Sections 191(2), 324(4), 296(b), 115(2) and 351(2) of BNS, 2023 and Section 4 of TNPHW Act, in Crime No.133 of 2026 on the file of the respondent police, seek anticipatory bail. 2. The case of the prosecution is that on 11.03.2026, at about 01.00 p.m., when the defacto complainant was in his home, the petitioners trespassed into his house and caused damage to 2/7 https://www.mhc.tn.gov.in/judis CRL OP(MD). No. 5826 of 2026 his compound gate. Further, they assaulted them and threatened them with dire consequences. Hence, the case. 3. The learned counsel for the petitioners would submit that the petitioners are innocent persons and they were falsely implicated in this case and they are no way connected in the above said incident. Hence, he prays to grant anticipatory bail to the petitioners. 4. The learned Government Advocate (Crl. Side) fairly submits that the petitioners have no previous cases and the injured person has been treated as out patient. However, he opposes to grant anticipatory bail to the petitioners. 5. Considering the rival submissions on either side and the nature of offences charged against the petitioners, and also considering the fact that the injured person has been treated as out patient and no previous case is pending against the petitioners, I am inclined to grant anticipatory bail to the petitioners, subject to the following conditions: [a] Accordingly, the petitioners are ordered to be released on anticipatory bail on condition to execute a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) each with two sureties each for a like sum to the satisfaction of the learned Judicial Magistrate, Nilakottai, and on further conditions that: [b] the petitioners shall report before the respondent police once in a week ie., on Every Saturday at 10.30 a.m., for a period of four weeks and 4/7 https://www.mhc.tn.gov.in/judis CRL OP(MD).
