Learned advocate appearing for the petitioners submits that the petitioners are in custody for 2 years 3 months and so far as the case is concerned, search and seizure is complete. The charges have been framed and the evidence of the case is in progress. Learned advocate for the State opposes the prayer for bail and submits that four witnesses have already been examined and the evidence of 5th witness is in progress. Having regard to the period of detention of the present petitioners, I am of the view that further detention of the petitioners is unwarranted. As such, the prayer for bail of the petitioners is allowed. The petitioner no.1, namely, Md. Mukaddar Sk @ Mosaraf and the petitioner no.2, namely, Umar Faruk shall be released on 2 bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) each with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned CJM, Malda. If on bail, the petitioners shall be physically present on each and every date before the learned court and shall not leave the district Malda without the prior permission of the learned trial court. Accordingly, CRM(M) 2441 of 2025 is allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
