: Mr. Deepika Jojowar, AC to SC-VI For BPCL
: Mr. Mrinal Kanti Roy, Advocate …...... 02 /28.07.2026:
The petitioner is challenging Annexure-7 which is “No Objection Certificate” issued by the Deputy Commissioner, Koderma in favour of Bharat Petroleum Corporation Ltd. to open a Retail Outlet at Mauja- Angar, Plot No.848, Khata No.22, Thana No.125, Area 900Sq. Mtr. Thana+ Circle-Satgawan, Dist- Koderma, State-Jharkhand. 2. It is the grievance of the petitioner that petitioner is having a civil dispute between him and respondent no.6 for which a Original Suit No.308 of 2020 is pending before Civil Court, Koderma. He submits that during pendency of the said Original Suit which involves the land in question, the Deputy Commissioner would not have issued “No Objection Certificate”. 3. Counsel appearing on behalf of respondent no.5, Bharat Petroleum Corporation Ltd. submits that they are going to set up Retail Outlet for which “No Objection Certificate” is necessary. 2 The Deputy Commissioner on the request of respondent no.6 has issued
“No Objection Certificate” to set up the retail Outlet. He submits that they will abide by the judgment passed in the Civil Suit. 4. Considering the said submission, since the Civil Suit is pending, the degree of the Civil Suit will prevail over the “No Objection Certificate”, if at all is necessary to amend, rescind or alter the same.
At this stage, I find no valid ground to interfere with the “No Objection Certificate”. 5. Accordingly, the instant writ petition stands dismissed. (ANANDA SEN, J.)
