Anticipatory bail in respect of the petitioner has been rejected during the early stages of investigation. At present charge sheet has been submitted and from the charge sheet it appears that the name of the petitioner herein transpired from the statement of the co-accused being the principal accused. Admittedly no recovery was made from the possession of the petitioner herein. 2. It is submitted by the learned counsel for the State that a warrant of arrest is pending against the petitioner herein. 2 3. Accordingly, the petitioner is directed to surrender before the trial court within seven days from the date of this order and the trial court shall consider the prayer of the petitioner, in view of the observations made by this Court in this order and shall be at liberty to pass such an order in accordance with law. 4. CRM (A) 314 of 2026 is, thus, disposed of. 5. Urgent photostat certified copy of this order, if applied for, be given to the parties on urgent basis after completion of all necessary formalities.
