Learned counsel appearing for the petitioner admits that the prayer for anticipatory bail of the petitioner herein has already been rejected by a Co-ordinate Bench on 23rd March, 2026 in CRM (A) 132 of 2026. 2. Learned counsel for the petitioner submits that there has been a change in circumstances as at present charge sheet has been submitted and as such he has again an application for consideration of his prayer for anticipatory bail. 3. Learned counsel appearing for the State fairly submits that though the order dated 23rd March, 2026 notes that there are phone call records of conversation between the petitioner 2 and the principal accused, the investigation which ended in a charge sheet, does not contain any CDR and as such this Court finds that the said statement of phone call records between the petitioner and the principal accused has not been prima facie substantiated at this stage. It further appears that the petitioner has thus been implicated in this case only on the basis of the said statement of the co-accused being the principal accused. 4. It also appears from the case diary that huge number of capsules, namely, SPMPRX + WOCKHARDT has been seized (6462 capsules) from the possession of the principal accused. 5. Considering that this is the second application for anticipatory bail, the prayer stands rejected with liberty granted to the petitioner to surrender before the trial court and pray for regular bail, which the trial court shall consider, in view of the observations made by this Court in the present order and pass an order in accordance with law. 6. The application for anticipatory bail stands disposed of. 7. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance with requisite formalities.
