Lr.No.DEE/APAM/PLND/Pedakurapadu/06 consisting of 6 works/2024,
Dt.26.09.2024 and p. 4 Lr.No.DEE/APAM/PLND/Pedakurapadu/06 consisting of 6 works/2024, Dt. 16.06.2025, even after completion of the works to the prescribed standards and within the stipulated time in relation to the works i.e., Package No. APAM/PLND/Pedakurapadu/06 consisting of (6) works in Pedakurapadu constituency of Palnadu District as per the Agreement No.26/2022-23, Dt. 14.09.2022, as illegal and arbitrary. 3. Counter affidavit was filed by the 6th respondent. It was contended that the petitioner has entered into agreement with the 5th respondent for execution of the work vide agreement dated 14.09.2022. The petitioner has executed the works and the same is recorded in M-Book by the Assistant Engineer. As per M-Book records, the gross amount is Rs.2,70,05,451/- and after statutory recoveries of Rs.18,89,556/-, the total net amount payable to the petitioner comes to Rs.2,51,15,895/-. QC is also conducted by the QC team and there is no recovery proposal. 4. A perusal of the counter affidavit would disclose that the petitioner has executed the aforementioned works and the net amount payable to the petitioner after statutory deductions is Rs.2,51,15,895/-. 5. Learned counsel for the petitioner endorses the same. 6. Thus, as seen from the instructions there is no dispute regarding the execution of works and the petitioner’s entitlement for Rs.2,51,15,895/-. Since the amount payable is admitted and undisputed, the writ petition is maintainable. In M/s Utkal Highways Engineers and Contractors v. Chief General Manager & Ors1, it was held at Para No.8 as under:
<Be that as it may, the High court has not dealt with the merits of the writ petition. Moreover, it is not an inviolable rule that no money claim can be adjudicated upon in exercise of writ jurisdiction.
Non-payment of admitted dues, inter alia, may be considered an arbitrary action on the part of p. 5

respondents and for claiming the same, a writ petition may lie.Further, throwing a writ petition on ground of availability of alternative remedy after 10 years, particularly, when parties have exchanged their affidavits, is not the correct course unless there are disputed questions of fact which by their very nature cannot be adjudicated upon without recording formal evidence.=. 7. Given the counter affidavit filed by the 6th respondent, the Writ Petition is disposed of directing the respondents to release an amount of Rs.2,51,15,895/- (Rupees Two Crores Fifty One Lakhs Fifteen Thousand Eight Hundred and Ninety Five only) payable to the petitioner regarding execution of the aforementioned work, within six (06) months from the date of receipt of the copy of this order. No order as to costs. As a sequel, pending miscellaneous petitions, if any, shall stand closed. ___________________________ JUSTICE SUBBA REDDY SATTI PVD
