02/ 30.07.2026: Heard learned counsel for the petitioners and learned counsel for the State. 2. The petitioners are apprehending their arrest in connection with Bariyatu P.S. Case No.58 of 2025, for the alleged offences registered under Sections 15(c), 18(b), 22, 25 and 29 of NDPS Act pending in the Court of learned Special Judge, NDPS, Latehar. 3. Learned counsel appearing for the petitioners submits that false allegation is made against the petitioners of cultivation of poppy plant on the forest land, gairmazarua land and on raiyati land. He further submits that the said lands are not belonging to the petitioners. He then submits that the petitioners have got no criminal antecedent as disclosed in paragraph No.6 of the petition and co-accused persons have been granted anticipatory bail in A.B.A. No. 797 of 2026 and in A.B.A. No. 2051 of 2026. 4. Learned counsel appearing for the State opposed the prayer and submits that the allegations are there of cultivation of poppy plant on forest land, gairmazarua land and on raiyati land. 5. Considering that the land is of the forest department and in the nature of gairmazurua land and raiyati land and it has been pointed out that

the lands are not belonging to the petitioners and the petitioners have got no criminal antecedent as disclosed in paragraph No.6 of the petition and in identical situation co-accused persons have already been granted anticipatory bail in the aforesaid ABAs, I am inclined to provide anticipatory bail to the petitioners. 6.
Accordingly, the petitioners, above named, are hereby directed to surrender before the learned Court within three weeks from today, and in the event of their surrender/arrest, the petitioners, above named, shall be released on bail, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each, with two sureties of the like amount each, to the satisfaction of learned Special Judge, NDPS, Latehar in connection with Bariyatu P.S. Case No.58 of 2025, subject to the conditions as laid down under Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023. Dt.30.07.2026
