Versus The State of Jharkhand
..... … Opposite Party
--------
CORAM : HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI
------ For the Petitioner : Mr. Anurag Kashyap, Advocate. For the State
: Mrs. Sushma Aind, A.P.P. For the Informant : Mr. Umesh Kumar Kashyap, Advocate. ------ 03/ 29.07.2026 Heard learned counsel for the petitioner, learned A.P.P for the State and learned counsel appearing for the informant.
2.
The petitioner is apprehending his arrest in connection with Sadar (Chatra) P.S. Case No. 174 of 2026 (arising out of Complaint Case no. 1350 of 2024), for the alleged offences registered under Sections 63, 64 and 123 of Bharatiya Nyaya Sanhita, 2023, pending in the Court of learned Chief Judicial Magistrate, Chatra.
3.
Learned counsel appearing for the petitioner submits that the petitioner happened to be the nephew of the informant. He next submits that the allegations have been made of establishing the relationship with the petitioner several times by the informant. He further submits that initially the complaint case was lodged, however, pursuant to the order of the learned court, the FIR has been lodged. He also submits that informant is an accused for the murder of her husband and her regular bail was rejected by the learned Chief judicial Magistrate, Chatra, wherein this fact has come that the informant has established the relationship with this petitioner. He then submits that at that time, the petitioner was a student and recently he has got appointment in the Indian Railway. He further submits that false allegations are made against the petitioner to save the skin from the murder case by the informant. On these grounds, he submits that

anticipatory bail may kindly be provided to the petitioner. 4. Learned A.P.P. appearing for the State and learned counsel appearing for the informant have jointly opposed the prayer and submit that there is direct allegation of establishing the relationship. Learned counsel appearing for the informant further adds that the relationship was established after mixing the intoxicating material in the cold drink. On these grounds, they submit that anticipatory bail may kindly be rejected. 5. It transpires that initially the complaint case was lodged, wherein the allegations have been made of establishing the relationship by way of serving intoxicated cold drink to the informant and that was going almost every day, which is not believable, as the said things if happened to a person and no understanding to that effect falsify and further the petitioner is the nephew of the informant and further the informant is also facing a case of murder of her own husband. 6. In the attending facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. 7.
Accordingly, the above-named petitioner is directed to surrender before the learned Court within three weeks from today and in the event of her arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Chatra, in connection with Sadar (Chatra) P.S. Case No. 174 of 2026 (arising out of Complaint Case no. 1350 of 2024), subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
