2. Heard Sri Anil Kumar Sharma, learned counsel for the applicant and Sri Ram Prakash Shukla, learned counsel for the State and perused the records.
3. The present application under Section 482 Cr.P.C. / under Section 528 B.N.S.S. has been filed by the applicant- Pintu with the prayer to allow the present application and quash the entire criminal proceeding against the applicant in pursuance of the order dated 05.12.2025, 27.01.2026, 27.02.2026 and 19.03.2026 passed by the A.C.J.M.-II, Kanpur Dehat in Case No. 1302 of 2004 (State Vs. Sunil & Another), under Sections 498, 376 I.P.C. and Section 3(1) (XII) of SC / ST Act, Police Station Rura, District Kanpur Dehat, by which the N.B.W. has been issued. It is further prayed that proceedings of the aforesaid case be stayed against the applicant during the pendency of the present application.

Learned counsel for the applicant submits that since N.B.W. has been issued against the applicant vide orders dated 05.12.2025, 27.01.2026, 27.02.2026 and 19.03.2026 the applicant may be permitted to appear before the trial court concerned and file a bail application which may be directed to be decided expeditiously.
5. Learned counsel for the State has no objection of aforesaid arguments of learned counsel for the applicant.
6. Prayer is allowed.
7. However, in view of the peculiar facts and circumstances of the case and looking to the limited prayer of learned counsel for the applicant it is directed that if the accused-applicant appears and applies for bail before the court Versus Counsel for Applicant(s) : Anil Kumar Sharma, Kapil Kumar Counsel for Opposite Party(s) : G.A. Pintu .....Applicant(s) State of U.P. and Another .....Opposite Party(s)
concerned by 20th May 2026 or earlier, the same shall be considered and decided in accordance with law.
8. Further if the applicant fails to appear by 20th May 2026 or before before the court concerned to file a bail application, the trial court shall proceed against him in accordance with law.
