Heard Mr. Ravi Kumar Bhagat, learned counsel for the appellant and Mr. Prasun Kumar Bhaduri, learned Deputy Advocate General, appearing for the State/respondents. 2. The matter has been listed in default on account of non- compliance with the procedural requirement, as learned counsel appearing for the appellant has failed to file the requisite Vakalatnama authorizing him to represent and argue the appeal on behalf of the appellant. 3. In absence of a duly filed Vakalatnama, this Court is not inclined to entertain the appeal any further, as the same reflects lack of diligence in prosecuting the matter. 4. At this stage, learned counsel for the appellant prays for withdrawal of the present appeal with liberty to file afresh. 5. In view of the foregoing discussion and considering the conduct of the appellant in not prosecuting the case diligently, the instant writ appeal deserves to be dismissed and is accordingly dismissed as withdrawn. However, in the interest of justice and to balance equities, the dismissal is made subject to the condition that the appellant shall deposit costs of ₹5,000/- (Rupees Five Thousand 3 Only) before the Registry of this Court within a period of one week from today. Upon deposit, the Registry is directed to forthwith remit the said amount to the Government School for Visual and Hearing Impaired, Tifra, District Bilaspur (Chhattisgarh), as a measure of social responsibility and for a charitable cause. 6. Certified copies of the documents annexed with the appeal, if any, shall be returned to the learned counsel for the appellant after retaining photocopies thereof on record.
