WAKODE, JJ. DATED : 13th January, 2026 Heard the counsel for the parties. 2. The petitioner-Trust was running a college viz. Shri Saibaba Adhyapak Mahavidyalay Gadchiroli. The petitioner has submitted an application to the respondent No.2-Gondwana University, Gadchiroli through its Registrar for the closure of the aforesaid college. The contention is that the aforesaid application was submitted on 08/07/2017 and till date, it has not been forwarded by the respondent No.2 to the Higher and Technical Education Department, State of Maharashtra for necessary orders and permission. Thus, the petitioner seeks direction of this Court to the respondent No.2 to forward necessary proposal within a stipulated period. 3. Shri S. S. Ghate, learned counsel for respondent No.2 has filed reply and has pointed out that the aforesaid proposal can be forwarded to the respondent No.1, however there are factual and statutory compliances which are inevitably needed to be complied with and without making compliance of and bypassing the same, recommendation can’t be made to the Government of Maharashtra. 2026:BHC-NAG:503-DB 2 107-WP-8140-23.odt 4. In view of above, Shri Kalwaghe, learned counsel for the petitioners submits that they are in the process of making such compliances as pointed by communication dated 13/01/2020 (record page No.53) and communication dated 14/01/2021 (record page No.54). 5. Accordingly, we dispose of the present petition with direction to respondent No.2 to forward the proposal of the petitioner- Management for closure of college viz. Shri Saibaba Adhyapak Mahavidyalaya, Gadchiroli after necessary compliances are made by the petitioner-Management as pointed out in communications dated 13/01/2020 and 14/01/2021 of the respondent No.2-University. 6.
