This is the 1st bail application filed under Section 483 of the Bhartiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail to the Applicant who has been arrested in connection with Crime No. 600/2025 registered at Police Station – Tikrapara, Raipur, District- Raipur (C.G.), for the offences under Sections 21(c) and 29 of NDPS Act.

As per the prosecution story, on 03.08.2025, the police allegedly received secret information regarding the illegal sale and purchase of a contraband substance (Heroin/Chitta) by the co-accused persons, namely Suvit Shrivastava, Lavjeet Singh, and others. 2 04, Kamal Vihar, Raipur, and allegedly recovered a contraband substance from the possession of the co-accused persons.

Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated in the present case. It is argued that no contraband has been seized from the possession of the applicant and his name has surfaced only on the basis of the memorandum statement of a co-accused person. He further submits that the applicant has been falsely implicated in the present case merely on the basis of his alleged acquaintance with the co-accused persons and certain alleged monetary transactions, without there being any direct evidence connecting him to the recovery of the commercial quantity of the contraband substance. He also submits that the applicant has no criminal antecedents and he is in jail since 24.10.2025, conclusion of the trial may take some time, therefore, it is prayed that he may be enlarged on regular bail. 4. On the other hand, learned State Counsel opposes the application and submits that as many as 28 accused persons are involved in the crime and approximately 402 gms of heroin has been seized during the investigation. It is further submitted that the case diary reveals links between the present applicant and the co-accused persons. However, she fairly concedes that no seizure has been effected from the possession of the present applicant. She further submits that the bail applications of eight other co-accused persons have already been rejected by this Court vide orders dated 23.02.2026, 27.02.2026, 23.03.2026, 01.04.2026 and 18.06.2026 passed in M.Cr.C. Nos. 10347/2025, 7965/2025, 2028/2026, 2678/2026, 2636/2026, 2899/2026, 2901/2026 and 5298/2026, respectively, therefore, the application for regular bail of the present applicant may also be rejected. 5. Having heard learned counsel for the parties and on perusal of the case
3 diary, this Court finds that the present case relates to a large-scale narcotics offence involving 28 accused persons and seizure of 402 grams of heroin. The material collected during investigation prima facie indicates the applicant's connection with the co-accused persons, including financial transactions with the main accused. Considering the nature and gravity of the offence, the allegations regarding the applicant's involvement in the criminal network and taking note of the fact that the bail applications of several co-accused persons have already been rejected by this Court, this Court is not inclined to grant regular bail to the applicant, at this stage. 6.
Accordingly, the bail application of the applicant – Krish Banjare involved in Crime No. 600/2025 registered at Police Station – Tikrapara, Raipur, District- Raipur (C.G.), for the offences under Sections 21(c) and 29 of NDPS Act, is hereby rejected. 7. Office is directed to send a certified copy of this order to the trial Court concerned for necessary information. Sd/-
