Through the medium of the instant petition filed under Article 226 of the Constitution of India, the petitioners, who are facing contempt proceedings before the Tribunal, are seeking indulgence of this Court to permit them to file statement of facts/compliance in response to the notice issued in the contempt petition. 2. It may be noted that in the petition filed by one-Sheikh Mohammad Imran registered as OA No. 152/2025, the Central Administrative Tribunal, Srinagar has passed an interim order dated 2nd June, 2026 directing the petitioners herein to maintain the position and status of the applicant as Librarian in Islamic University of Science and Technology Kashmir in tune with the order of his appointment dated 17th January, 2025. 3. Feeling aggrieved of the aforesaid interim direction, the petitioner- University filed WP(C) No. 1465/2026 which was disposed of by this Court vide order dated 4th July, 2026. The order dated 2nd June, 2026 impugned in the writ petition was not interfered with by us and instead the University of Kashmir was directed not to extend the retention of lien beyond September, 2026 unless further extension was permissible under rules. We also requested the Tribunal to make an effort to dispose of the OA or, in the alternative the application for interim relief within a period of two months from the date of passing of the order i.e. 4th July, 2026. Two months period is yet to be over and, therefore, the OA as also the application for interim relief awaits its consideration and disposal. 4. Be that as it may, there should be no dispute with regard to the fact that the interim order passed by the Tribunal dated 2nd June, 2026 continues to be in operation and is required to be complied with by the petitioners herein in letter and spirit. It is only if upon consideration of the matter the OA is dismissed or the interim order dated 2nd June, 2026 is vacated, the situation may change. If it is the impression of the petitioners that till the OA is decided or application for interim relief is taken up for consideration as directed by this Court, they are not obliged to comply with the interim order dated 2nd June, 2026, then they are living in the fool’s paradise. 5. It seems that having taken note of these aspects, the Tribunal insisted for compliance of the order dated 2nd June, 2026. It is true that the Tribunal has shown little hurry in getting the compliance and has not afforded reasonable opportunity to the respondents to submit compliance which has resulted into passing of some harsh orders, but it also cannot be lost sight of that the response of the petitioners to the contempt notice too has not been quick and responsible. 6. Be that as it may, with a view to affording a reasonable opportunity to the petitioners to file the statement of facts/compliance, we grant them two weeks’ time from today to submit a compliance report before the Tribunal. 7. The matter shall be postponed and shall be taken up for consideration on 3rd August, 2026. 8. The Tribunal shall be free to pass appropriate orders after consideration of statement of facts/compliance filed by the petitioners. Whether or not the contempt notice would be required to be issued shall depend on the consideration so accorded to the matter by the Tribunal on the next date of hearing. Till such order upon consideration is passed by the Tribunal, the petitioner shall remain exempted from personal appearance. 9. This petition is disposed of.
