JUSTICE RONGON MUKHOPADHYAY HON’BLE MR. JUSTICE ARUN KUMAR RAI ------- For the Appellants : Mr. Birendra Kumar, Advocate For the State : Mr. Rajneesh Vardhan, A.P.P. For the Informant : Mr. Pratiush Lala, Advocate ----- Order No.03/Dated: 27.07.2026 1. Heard Mr. Birerndra Kumar, learned counsel for the appellants, learned A.P.P. as well as Mr. Pratiush Lala, learned counsel appearing for the informant. 2. This appeal is directed against the order dated 12.06.2026 passed in A.B.P. No. 937 of 2026 arising out of Tisra P.S. Case No. 24 of 2026 by the learned Sessions Judge, Dhanbad, whereby and whereunder the prayer for anticipatory bail of the appellants has been rejected. 3. It has been alleged that on 11.05.2026 several persons variously armed had entered into the house of 2026:JHHC:22057-DB 2 the informant in order to bodily harm him. The cousin brother of the informant, namely, Rajat Paswan intervened as a result of which he was assaulted on his head with the butt of a pistol by Vicky Paswan. When the neighbours gathered, the accused persons fled away by throwing bombs and hurling pistols. 4. Submission has been advanced by the learned counsel for the appellants that the main allegation of committing assault is upon Vicky Paswan and Vishal Gupta. It has been submitted that appellants have been implicated only on account of the fact that they were present at the place of occurrence. 5. It has further been submitted that neither the informant nor the said Rajat Paswan has suffered any injuries. 6. Learned A.P.P. as well as learned counsel for the informant have opposed the prayer for anticipatory bail of the appellants. 7. Mr. Pratiush Lala, learned counsel for the informant has submitted that the evidence of the witnesses clearly reveals about the presence of the appellants at the place of occurrence. 8. It appears that it was Vicky Paswan and Vishal Gupta who were said to have committed assault upon the informant and Rajat Paswan and as per the learned counsel for the appellants no injuries were found on their person. 9. As regards the present appellants are concerned, it seems that so far as appellant no. 1 is concerned, one motorcycle was recovered from the place of occurrence but on an overall view of the case, the allegation against all the appellants appears to be 2026:JHHC:22057-DB 3 general and omnibus in nature and no overt act has been alleged against any of the appellants of actively participating in the assault committed upon the informant and his cousin brother Rajat Paswan. 10. On consideration of the aforesaid fact, we while setting aside the order dated 12.06.2026 passed in A.B.P. No. 937 of 2026 arising out of Tisra P.S. Case No. 24 of 2026 by the learned Sessions Judge, Dhanbad, direct the appellants to surrender before the learned trial court within a period of four weeks and on their surrender, they shall be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Dhanbad. 11. This appeal is allowed. (Rongon Mukhopadhyay, J.) (Arun Kumar Rai, J.) 27th July, 2026 R.K/Rajnish
