This petition has been filed under Article 226 of the Constitution of India for quashing of the letter dated 14.11.2012 whereby penalty to the tune of Rs.45,38,953.84 have been imposed upon the petitioner and the security deposit of Rs.10 lacs has been adjusted in the said penalty and further demand is made of Rs.35,38,953.84/- as penalty. 3. Learned counsel appearing for the petitioner submits that representation of the petitioner is still pending before the Chairman- cum-Managing Director, Central Coalfields Limited vide Annexure-7 and no decision has been taken as yet on that. He further submits in view of that the writ petition may kindly be disposed of to take appropriate decision in light of representation within the stipulated time. 4. Learned counsel appearing for the CCL submits that for the dispute in question the petitioner may kindly be directed to approach the competent court of civil jurisdiction. 5. In view of the above and considering that representation of 2026:JHHC:22236 --3-- W.P. (C.) No. 2884 of 2014 the petitioner is pending and in view of that without entering into the merit of the case, this writ petition is being disposed of with direction to the petitioner to file a fresh representation before the respondent No.2 within two weeks and the respondent No.2 will take a final call on the said representation of the petitioner within four weeks further thereafter. 6.
