Case No.1375 of 2025 dated 19.10.2025 under Sections 21(c)/27A/29 of the NDPS Act, 1985. And In the matter of: Masidur Sk. … petitioner Md. Wasim Akram … for the petitioner Mr. Krishendu Bhattacharya Mr. Saswata Chatterjee … for the State Memo of evidence filed by the State is taken on record. Learned counsel for the petitioner submits that the only material available against the petitioner is the statement of a co-accused. The alleged phone call records pertain to a phone number which belongs to the wife of the petitioner’s brother. The petitioner’s brother is still in custody. Charge- sheet has been submitted. Learned Additional Public Prosecutor representing the State strongly opposes the prayer for anticipatory bail, relies on the case diary and the report and submits that 1 kg 343 gm heroin was recovered from one co-accused viz Kanchan Devi. The petitioner and his brother were using the same phone number which was in the name of the wife of petitioner’s brother. With this phone number the petitioner and his brother made as many as 293 calls with the said 2 accused Kanchan Devi and 617 calls with another co- accused Sujit (resident of Bihar) at the relevant time. Considering the above, the other materials available in the case diary and the restrictions contained in Section 37 of the NDPS Act, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
