Heard Mr. Ram Lakhan Yadav, learned counsel for the petitioner and learned A.C. to S.C.-IV.
2. In this writ application, the petitioner has prayed for a direction upon the respondent no. 3 to pass an appropriate order to release the seized commercial vehicle (Hydraulic Excavator Model type no. R210-7, Serial No. N601D05971) in favour of the petitioner, as the same has been seized in connection with Complaint Case No. 290 of 2023.
3. By virtue of an amendment application having been allowed in I.A. No. 10277 of 2025, the petitioner has also prayed for quashing of the Confiscation Case No. 07 of 2023 initiated by the Range Forrest Officer, Mandro Domin Renge, Mandro Sahibganj.
4. During the pendency of this writ application, it was submitted by learned A.C. to S.C.-IV that Confiscation Case No. 07 of 2023 has already been disposed of.
5. Consequent to the said submission, vide order dated 29.06.2026, he was directed to take instruction as to whether any appeal has been preferred against the said order or not. It was further directed vide order dated 13.07.2026 to bring the order with respect to Confiscation Case No. 07 of 2023 on record.

6. Today learned A.C. to S.C.-IV has submitted at the Bar a copy of the
order dated 26.08.2023, which has disposed of Confiscation Case No. 07 of
2023.
7. Since the Confiscation Case which forms the crux of the prayer made in this writ application has already been disposed of by the respondent no. 3, the prayer made in this writ application, consequently, does not survive, and the same accordingly stands disposed of. However, since it has been submitted by Mr. Ram Lakhan Yadav, learned counsel for the petitioner that he was not aware of the order dated 26.08.2023 passed in Confiscation Case No. 07 of 2023 and he intends to prefer an appeal with an application for condonation of delay, if the same is preferred, it is expected that the appellate authority shall take a considerate view of the matter and shall also take into consideration the fact that the petitioner has chosen a wrong forum for redressal of his grievance.
8. Let a copy of the order passed in Confiscation Case No. 07 of 2023 as submitted at the Bar be kept on record.
9. Accordingly, this writ application stands disposed of.
