2. In this writ petition, the petitioner is assailing the Memorandum dated 30.04.2026 (Annexure-H) passed by respondent No. 4, inter-alia sought for direction to respondents to conduct re-survey of the schedule property as stated in the representation dated 21.04.2026 (Annexure-K).
3. Heard the learned counsel appearing for the parties.
4. Having taken note of the submissions made by the learned counsel appearing for the parties, on careful
consideration of the Memorandum dated 30.04.2026 (Annexure-H) passed by the respondent No.4, would indicate that the said Memorandum has been issued without providing opportunity of hearing to the petitioner. Therefore, the said memorandum requires to be set aside. Accordingly, Memorandum dated 30.04.2026 issued by the respondent No.4 is set aside.

5. The controversy between the parties is with regard to boundaries of the schedule property and in that view of the matter, the respondent Nos.4 and 5 are
directed to conduct the joint survey of the schedule property in the presence of the petitioner and, thereafter, take appropriate action in accordance with law. In order to expedite the process, Respondent Nos. 4 and 5 are further directed to conduct the joint survey on 20.07.2026 at 11:00 a.m. in the presence of the petitioner.
6. Till the conclusion of the joint survey and further proceedings, the respondents are restrained from taking any coercive steps against the petitioner. With these observations, the writ petition stands
disposed of.
