THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE H.P.SANDESH ORAL ORDER This Court vide order dated 16.04.2025 suspended the sentence subject to depositing of 50% of the fine amount including the amount already deposited (if any) within a period of one week from the date of order and the revision petitioner has not complied with the same. When the revision petitioner sought time on 24.04.2025 to extend the time, two weeks time is granted to deposit the same and in spite of it, the revision petitioner has not complied with the same. 2. Earlier, even the matter was referred to the Mediation vide order dated 21.07.2025 and also a direction has been given to the revision petitioner to appear before the Special Mediation Drive on 09.02.2026 vide order dated 28.01.2026. Both the parties never - 3 - HC-KAR NC: 2026:KHC:29619 CRL.RP No. 821 of 2024 appeared before the mediation and the matter is not settled and the matter is listed today i.e. 17.06.2026 before this Court for referring the same to Lok-Adalath. 3. Today also, there is no representation on behalf of revision petitioner and he is not pursuing the matter diligently. As such, there is no meaning in referring the matter to Lok-Adalath or for mediation as the petitioner is not complied with the conditional order even extending the time to comply the same. 4. This revision is against the concurrent finding and the trial Court in C.C.No.1245/2018 has directed the revision petitioner to pay fine amount of Rs.2,75,000/- and in default to pay the fine amount, to undergo simple imprisonment of three months and the same is confirmed in Crl.A.No.335/2023 by dismissing the appeal as there was no representation before the appellate Court. Further, the revision petitioner has not deposited 25% of the fine amount before the appellate Court and the same is noted - 4 - HC-KAR NC: 2026:KHC:29619 CRL.RP No. 821 of 2024 in the order sheet dated 16.12.2023. Moreover, the matter is not yet admitted. 5. Under the aforesaid circumstances, question of consideration of this revision petition does not arise and accordingly, the revision petition stands dismissed in view of not pursuing the matter and non-compliance of the conditional order dated 16.04.2025.
