Accused No.3 in SC No.54/2026 pending before the Court of VI Additional District and Special Judge, Mysuru, arising out of Crime No.99/2025 registered by Nanjangudu Town Police Station, Mysuru, for the offences punishable under Sections 126(2), 54, 103(1), 61(1), 61(2)(a), 238 read with Section 3(5) of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.99/2025 was registered by Nanjanagudu Town Police Station, Mysuru, initially for the offence punishable under Section 309(6) of BNS, 2023, against 3 to 4 unknown persons based on the first information dated 26.10.2025 received from Rajendra N, S/o Ningachari, who is the deceased in the present case. During the course of investigation, petitioner herein was arrested on 27.10.2025. After completing investigation, charge sheet has been filed against three persons and another juvenile accused. Bail application filed by the - 3 - HC-KAR NC: 2026:KHC:29741 CRL.P No. 5964 of 2026 petitioner before the Trial Court in SC No.54/2026 was rejected on 16.03.2026. Therefore, he is before this Court. 4. In the first information, which was submitted by deceased Rajendra on 26.10.2025, he has stated that on 25.10.2025 at about 07.45 p.m. when he and his wife Sangeetha (accused No.1) were returning home in his scooter, all of a sudden, three persons, who came in a car, got down from the said car and one amongst them raised a quarrel with him and pushed his scooter. The other two accused, who came in the said car allegedly tried to snatch the gold jewellery, which his wife was wearing. When his wife raised a cry, one amongst the said accused allegedly stabbed him with a knife and as a result, he fell down. Thereafter, the said accused persons escaped from the spot in the car in which they had arrived. It is under these circumstances, FIR was registered for the offence punishable under Section 309(6) of BNS, 2023, against three to four unknown persons. 5. During the course of investigation, petitioner and others have been arrested. In the charge sheet, which is filed subsequently, it is alleged that Sangeetha (accused No.1) and - 4 - HC-KAR NC: 2026:KHC:29741 CRL.P No. 5964 of 2026 her husband Rajendra (deceased) were married about 5 to 6 years prior to the alleged date of incident. Subsequently, there was a difference of opinion between the couple and deceased Rajendra allegedly used to abuse and assault his wife Sangeetha. It is in this background, she had contacted her brother accused No.2/Sanjay and had conspired with him to commit the murder of her husband Rajendra. Accused No.2 in turn contacted his friends accused No.3 and another juvenile accused and on 25.10.2025, in furtherance of their conspiracy, when deceased and his wife Sangeetha were returning home in their scooter, accused Nos.2 and 3 and the juvenile, who came in a car bearing Reg.No.KA09/MB2499 intercepted the scooter of deceased. Petitioner, who got down from the said vehicle allegedly quarrelled with the deceased and when the juvenile accused held the deceased, petitioner allegedly stabbed him and committed his murder. 6. Allegations now found in the charge sheet against accused persons are contradictory to the statement made by deceased to the police based on which, FIR has been registered in the present case. According to the deceased, all the three - 5 - HC-KAR NC: 2026:KHC:29741 CRL.P No. 5964 of 2026 persons, who came in the car, got down from the said car and had attacked him and his wife. As per the charge sheet allegations, accused No.2, who is the brother-in-law of the deceased Rajendra was also one of the inmates of the said car. If that is so, in the first information, the same should have been mentioned. Even otherwise, the entire case of the prosecution is based on circumstantial evidence. Petitioner aged 20 years having no criminal antecedents is in custody from 27.10.2026. In view of the aforesaid analysis of the matter, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. Accordingly, the following order:- 7. The petition is allowed. The petitioner is directed to be enlarged on bail in SC No.54/2026 pending before the Court of VI Additional District and Special Judge, Mysuru, arising out of Crime No.99/2025 registered by Nanjangudu Town Police Station, Mysuru, for the offences punishable under Sections 126(2), 54, 103(1), 61(1), 61(2)(a), 238 read with Section 3(5) of BNS, 2023, subject to the following conditions: - 6 - HC-KAR NC: 2026:KHC:29741 CRL.P No. 5964 of 2026 a) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
