JUSTICE ANIL KUMAR CHOUDHARY ------ For the Petitioner : Mr. Pratik Sen, Advocate For the State : Mr. Bhola Nath Ojha, Spl.P.P ------ Order No.02 Dated- 28-07-2026 Heard the parties. The petitioner has moved this Court for grant of bail in connection with Barhi P.S. Case No.231 of 2025 registered for the offences punishable under sections 18(c), 20(ii)B & 25 of NDPS Act. Learned counsel for the petitioner files supplementary affidavit. Keep the same in the record. The learned counsel for the petitioner submits that the allegation against the petitioner is that the petitioner was involved in sale and purchase of opium and Ganja and 1.09 kg of opium and 5.136 of Ganja was seized from the house of the petitioner. It is further submitted that the allegations against the petitioner are all false. It is then submitted that both opium and ganja come under intermediate quantity. It is next submitted that the petitioner has no criminal antecedent as has been mentioned in paragraph no.03 of the supplementary affidavit as Final Form has been submitted against him in Barhi P.S. Case No.294 of 2020 and the proceedings have been dropped upon acceptance of Final Form. It is then submitted that the petitioner has been in custody since 27.06.2026, as has been mentioned in paragraph no.07 of the bail application. It is next submitted that the petitioner undertakes to cooperate with the trial of the case and further undertakes that he will not annoy or disturb the witnesses of the case in any manner during the trial of the case. Hence, it is submitted that the petitioner be admitted to bail. The learned Spl. P.P. opposes the prayer for bail. Considering the submissions of the counsels and the fact as discussed above, I am inclined to enlarge the abovenamed petitioner on bail. Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge-cum-Special Judge, NDPS Act, Hazaribagh, in connection with Barhi P.S.
