Accused in Crime No.205/2026 registered by HSR Layout Police Station, Bengaluru City, for the offence punishable under Section 108 of BNS, 2023, is before this Court in this petition filed under Section 483 of BNSS, 2023, seeking regular bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.205/2026 was registered by HSR Layout Police Station, Bengaluru City, for the aforesaid offence against the petitioner herein based on the first information dated 12.05.2026 received from Ashok Kumar B.Parikh - father of deceased Jyoti Ashok Parikh. In the said case, petitioner herein was arrested on 12.05.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl. Misc. No.4777/2026 was rejected on 27.05.2026. Therefore, petitioner is before this Court. 4. Perusal of the first information would reveal that petitioner and deceased Jyothi who was a divorcee had met in the year 2014 and subsequently they got married in the year - 3 - HC-KAR NC: 2026:KHC:29796 CRL.P No. 7566 of 2026 2016. The allegation in the first information is that subsequently petitioner who was the husband of Jyothi was not properly taking care of her daughter who was born from her first marriage. Therefore, Jyothi allegedly suffered mental harassment and was depressed. It is also stated in the complaint that she had observed that petitioner had extra- marital relationship with a girl and it is under these circumstances, she had committed suicide by hanging on 11.05.2026. 5. The averments found in the first information are not sufficient to attract the offence punishable under Section 108 of BNS, 2023. For the purpose of attracting the said offence, the act committed by the petitioner should have nexus with the death of the deceased and such an act should have either abated, instigated or aided the deceased to commit suicide. Such ingredients are not found in the first information. Petitioner is in custody from 12.05.2026. Major portion of the investigation has been completed. Under the circumstances, I am of the opinion that petitioner's prayer for grant of regular - 4 - HC-KAR NC: 2026:KHC:29796 CRL.P No. 7566 of 2026 bail is required to be answered affirmatively. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in Crime No.205/2026 registered by HSR Layout Police Station, Bengaluru City, for the offence punishable under Section 108 of BNS, 2023, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said - 5 - HC-KAR NC: 2026:KHC:29796 CRL.P No. 7566 of 2026 Court until the case registered against him is disposed off.
