APP Mr. Sankalpa Bhattacharya ….for the State Learned senior counsel appearing on behalf of the petitioner submits that the only material available against the petitioner is the statement of a co-accused, which is not admissible in evidence. Learned APP representing the State relies on a report, which is taken on record and the case diary and opposes the prayer for anticipatory bail. He refers to the statement of a co-accused and submits that there is a criminal antecedent against the petitioner being, Lalgola P.S. Case No. 930 dated 29.10.2025. There were also phone calls made between the present petitioner, a resident of village Natun Naldahari and the co-accused, Rakibul Sk, a resident of village Teghari Koyalpara. There were as many as 76 phone calls made between the two between 9.10.2025 and 07.01.2026. Considering the above, the other incriminating materials available in the case diary and the restriction contained in Section 37 of the 2 NDPS Act, I do not consider this to be a fit case for granting anticipatory bail. The application for anticipatory bail is, thus, rejected. Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities. (Jay Sengupta, J.)
