Accused in Crime No.29/2026 registered by Sarjapura Police Station, Bengaluru, for the offence punishable under Section 108 of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned counsel for the parties. 3. FIR in Crime No.29/2026 was registered by Sarjapura Police Station, Bengaluru, for the aforesaid offence against the petitioner herein, based on the first information dated 02.02.2026 received from Gajendran, father of deceased Yashwanth. Apprehending arrest in the case, petitioner had filed Crl.Misc.No.5127/2026 before the jurisdictional Sessions Court, which was rejected on 27.03.2026. Therefore, he is before this Court. 4. In the first information submitted by the father of deceased on 02.02.2026, he has stated that his son Yashwanth was working with the petitioner and on 01.02.2026, petitioner allegedly had called first informant and informed him that his - 3 - HC-KAR NC: 2026:KHC:29733 CRL.P No. 5906 of 2026 son was demanding money and he had paid him Rs.2,000/- and he is asking for additional amount of Rs.2,500/-. First informant allegedly informed the petitioner to pay the said amount. Subsequently, the first informant came to know that his son Yashwanth had committed suicide by hanging himself after recording a video. According to the first informant, since the petitioner was not properly paying salary to the deceased, he had committed suicide. The allegations made in the first information are prima facie not sufficient to attract the offence punishable under Section 108 of BNS, 2023. Necessary ingredients to attract the said offence is not found in the first information. Petitioner, who has no criminal antecedents has undertaken to co-operate with the police for the purpose of investigation. Accordingly, the following order:- 5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.29/2026 registered by Sarjapura Police Station, Bengaluru, for the offence punishable under Section 108 of BNS, 2023, subject to the following conditions: - 4 - HC-KAR NC: 2026:KHC:29733 CRL.P No. 5906 of 2026 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner shall not tamper with the prosecution witnesses and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
