THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Heard the learned Counsel for the parties. 3. FIR in Crime No.73/2026 was registered by Chikkajala Police Station, Bengaluru City, for the aforesaid offences against the petitioners herein based on the first information dated 28.03.2026 received from Patalappa who is the injured victim in the present case. Apprehending arrest in the said case, petitioners herein had filed Crl. Misc. No.15074/2026 before the jurisdictional Sessions Court, which was rejected on 15.04.2026. Therefore, they are before this Court. - 3 - HC-KAR NC: 2026:KHC:29794 CRL.P No. 6397 of 2026 4. Perusal of the material on record would go to show that the victim and the petitioner are from the same village and they are acquainted to each other. Incident in question had taken place after the parties had quarreled on the issue of putting up banner during the village festival. In the alleged incident, first informant has suffered one injury which is said to be simple injury in the wound certificate issued by the doctor who has treated the first informant. Undisputedly, petitioners do not have criminal antecedents and they have undertaken to co-operate with the police for the purpose of investigation. Under the circumstances, I am of the opinion that petitioners prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 5. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of their arrest in Crime No.73/2026 registered by Chikkajala Police Station, Bengaluru City, for the offences punishable under Sections 118(2), 3(5), 352 of BNS, 2023, subject to the following conditions: - 4 - HC-KAR NC: 2026:KHC:29794 CRL.P No. 6397 of 2026 1. Petitioners shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioners shall not tamper with the prosecution witness and they shall co-operate with the police for investigation and appear before them whenever called upon. 4. The petitioners shall not involve in similar offences in future. Sd/- (S VISHWAJITH SHETTY) JUDGE KK
