HC-KAR NC: 2026:KHC:26295 RPFC No. 262 of 2024 C/W RPFC No. 102 of 2025
CORAM: HON'BLE DR. JUSTICE CHILLAKUR SUMALATHA ORAL ORDER Heard Sri.Roopesha.B
learned counsel for the petitioner in RPFC No.262/2024 who is also representing the respondent in the connected matter i.e., RPFC No.102/2025. Also heard Sri.P.Mahesha learned counsel for the respondents in RPFC No.262/2024 who is appearing for the petitioners in RPFC No.102/2025. 2. These two revision petitions are the outcome of the order that is rendered by the Court of V Additional Principal Judge, Family Court, Bengaluru in Crl.Misc.No.266/2017 dated 13.08.2024. 3. As the status of the parties to the revision petitioners is not in dispute, they will be hereinafter be called as a husband, wife and daughter. 4. Wife and daughter filed a petition under Section 125 Cr.P.C. claiming Rs.15,000/- per month towards the maintenance of the daughter. Family Court directed

HC-KAR NC: 2026:KHC:26295 RPFC No. 262 of 2024 C/W RPFC No. 102 of 2025 husband to pay daughter a sum of Rs.8,000/- per month towards maintenance till her marriage or till she becomes financially independent whichever is earlier. When husband filed RPFC.No.262/2024 with a contention that the amount awarded as maintenance is exorbitant, wife and daughter filed RPFC.No.102/2025 stating that sum granted towards monthly maintenance in favour of the daughter is on lower side. 5. Arguing the matter, learned counsel who represents the husband submits that wife is working as a teacher at a Government High School and earns not less than Rs.80,000/- per month. On the other hand, husband is doing a private job and earns around Rs.15,000/- per month. Wife is therefore financially sound compared to husband. She can take good care of the child. As the husband earns meager amount, he can only pay a sum of Rs.5,000/- per month towards the maintenance of the daughter. Therefore, the revision petition filed by the

On the other hand, learned counsel who represents wife and daughter submits that husband used to work at Tata Capital Services and was drawing Rs.30,000/- per month. He also gets around Rs.20,000/- per month as rent. Husband himself voluntarily resigned the job and got better employment. Daughter requires huge sum for her education. Wife is unable to meet all the requirements. That apart, husband is residing in his own house, whereas wife and daughter are residing in a rented house.
The amount granted towards maintenance of the daughter is too meager and therefore, allowing the revision petition filed by the wife and daughter, the sum claimed by them may be granted. 7. As per the document produced by the husband himself i.e., Ex.R1, he worked as Senior Customer Relationship Executive-Car Finance and was drawing

HC-KAR NC: 2026:KHC:26295 RPFC No. 262 of 2024 C/W RPFC No. 102 of 2025 Rs.19,560/- per month in 2014. As per the contents of Ex.R2, husband himself submitted a resignation letter and got relieved in the year 2016. 8. It is not the version of the husband that he is not able bodied or that he suffers with any deficiencies or disabilities to take up work and earn. Having given birth to a child, it is his obligation to maintain the child, provide proper education, nourishment, clothing and other facilities. Family Court, taking into consideration the totality of facts and circumstances and the evidence produced, ordered husband to pay the child a sum of Rs.8,000/- per month towards maintenance. Sum thus fixed cannot be held to be exorbitant or on lower side. This Court therefore does not find any grounds either to reduce the sum fixed by the Family Court or to enhance the same. This Court is not inclined to disturb the findings given, as those findings are based on valid reasons. Hence both the revision petitions are disposed of with the following:
