Accused nos.5 & 6 in Crime No.77/2025 registered by City Railway Police Station, Bengaluru, for the offences punishable under Sections 108, 140(3), 351(1) read with 3(5) of BNS, 2023, are before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. Learned Counsel for the petitioners submits that petitioner no.2/accused no.6 has been already granted anticipatory bail by this Court in Crl.P.No.4694/2026 disposed of on 10.06.2026, and therefore, the present petition may be dismissed as not pressed. 4. FIR in Crime No.77/2025 was registered by City Railway Police Station, Bengaluru, for the aforesaid offences against Anitha Asode and others based on the first information dated - 3 - HC-KAR NC: 2026:KHC:29049 CRL.P No. 5763 of 2026 17.10.2025 received from Basavaraja Bhimappa Halagani, brother of deceased Siddagond Halagani. Petitioner herein is arrayed as accused no.5 in the FIR. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.62/2026 before the jurisdictional Sessions Court, which was rejected on 12.03.2026. Therefore, he is before this Court. 4. Material on record would go to show that accused no.1 in the present case is a practicing advocate and she had filed a complaint against deceased Siddagond Halagani in Crime No.312/2025 registered by Basaveshwaranagar Police Station, Bengaluru, for the offences punishable under Sections 74, 61(2)(m), 69, 115(2), 352, 351(2)of BNS, 2023 and Sections 3(1)(r)(s), 3(1)(w)(i)(ii), 3(2)(V) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, and in the said case, deceased Siddagond Halagani was arrested and remanded to judicial custody. He had filed bail application before this Court in Crl.A.No.1937/2025 and in the said case, he had filed an affidavit before this Court seeking interim bail so as to enable him to marry the victim in the said case, who is arrayed as accused no.1 in the present case. - 4 - HC-KAR NC: 2026:KHC:29049 CRL.P No. 5763 of 2026 5. The allegation now made in the present case becomes doubtful having regard to the averments found in the affidavit filed by the deceased in Crl.A.No.1937/2025. It is under these circumstances, accused nos.1 to 3 and 6 have been granted anticipatory bail in the present case by this Court in Crl.P.No.4694/2026. Petitioner herein is said to be relative of accused no.1. He does not have criminal antecedents. Petitioner has undertaken co-operate with the police for the purpose of investigation. Under the circumstances, petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively on the ground of parity. Accordingly, the following order: 6. The petition is allowed in part. Petition as against petitioner no.2/accused no.6 is dismissed as not pressed. Petition as against petitioner no.1/accused no.5 is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner no.1/accused no.5 in the event of his arrest in, subject to the following conditions: - 5 - HC-KAR NC: 2026:KHC:29049 CRL.P No. 5763 of 2026 1. The Petitioner/accused no.5 shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner/accused no.5 shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. 3. Petitioner/accused no.5 shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
