Petitioner who is apprehending arrest in Crime No.156/2025 registered by Jigani Police Station, Bengaluru District, for the offences punishable under Sections 316(2), 340(2), 61(2)(b), 318(4), 336(3) read with 3(5) of BNS, 2023, is before this Court in this petition filed under Section 482 of BNSS, 2023, seeking anticipatory bail. 2. Heard the learned Counsel for the parties. 3. FIR in Crime No.156/2025 was registered by Jigani Police Station, Bengaluru District, against the petitioner herein for the aforesaid offences based on the first information dated 05.09.2025 received from Damodaran who is the authorized representative of the company known as Maxworth Home Limited. Apprehending arrest in the said case, petitioner had filed Crl. Misc. No.5138/2026 before the jurisdictional Sessions Court, which was rejected on 24.03.2026. In the typed first information dated 05.09.2025 submitted by the authorized representative of the company known as Maxworth Home Limited, it is stated that after the complainant- company came to know that petitioner along with Oraiyan Group was offering plots for sale in the illegally formed layout in the property belonging to the company, they had got issued public notice apart from erecting notice boards in the site and making complaint at Jigani police station. 5. From the aforesaid averments, it prima facie appears that there is a dispute between the two parties with regard to the sites which are formed in the layout. Even prior to registration of the present FIR, the first informant had approached the very same police station, as stated in the present first information. 6. The submission made by the learned Counsel for the petitioner that petitioner has no criminal antecedents is not seriously disputed. The documents which are allegedly forged are available with the company or in the office of the Sub- Registrar. Petitioner who has no criminal antecedents, has undertaken to co-operate with the police for the purpose of investigation. The alleged offences are triable by the Court of - 4 - HC-KAR NC: 2026:KHC:29793 CRL.P No. 6261 of 2026 Magistrate and maximum punishment for the same is imprisonment for a period of seven years. Under the circumstances, I am of the opinion that petitioner's prayer for grant of anticipatory bail is required to be answered affirmatively. Accordingly, the following order: 7. The petition is allowed. The respondent - Police or any other police in the State of Karnataka are directed to release the petitioner in the event of his arrest in Crime No.156/2025 registered by Jigani Police Station, Bengaluru District, for the offences punishable under Sections 316(2), 340(2), 61(2)(b), 318(4), 336(3) read with 3(5) of BNS, 2023, subject to the following conditions: 1. The Petitioner shall appear before the Investigating Officer within 15 days from the date of receipt of the copy of this order and shall execute a personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum to the satisfaction of the investigating officer. 2. Petitioner shall regularly appear before the Trial Court without fail unless exempted by the Trial Court for valid reasons. - 5 - HC-KAR NC: 2026:KHC:29793 CRL.P No. 6261 of 2026 3. Petitioner shall not tamper with the prosecution witness and he shall co-operate with the police for investigation and appear before them whenever called upon. 4.
