This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed by the applicants, who are apprehending their arrest in connection with Crime No.111/2025 registered at Police Station – Patna, District – Koriya (C.G.) for the offence punishable under Sections 61(2), 190, 191(3), VAISHALI LUCKY NAGARIA Digitally signed by VAISHALI LUCKY NAGARIA Date: 2026.01.12 10:55:42 +0530 2 221, 351(2), 115(1), 115(2), 132, 109(1) of BNSS, 2023. 2. As per prosecution case, on a report of complainant Bhupendra Kumar Pandey, Patna police station has registered a case against applicants/accused Praveen Dubey, Somar Sai, Baban Yadav, Gorelal and other co- accused under sections 61(2), 190, 191(3), 221, 351(2), 115(1), 115(2), 132 BNS under crime number 111/2025. Section 109 (1) BNS has been added to the case during investigation.The allegations against the applicants/accused Praveen Dubey, Somar Sai, Baban Yadav, and Gorelal are that on 30.05.2025, at approximately 11:40 a.m., a truck numbered CG 10 BK-0342, contracted for coal transportation in the SECL Jhilimili area, loaded with coal from the Jhilimili mine and was being transported to Kator Siding by the security in-charge Puran Singh and deputy security in-charge Azad Khan. The applicants/accused and 20-30 other villagers, armed with sticks, rods, crowbars, etc., stopped the loaded coal truck numbered CG 10 BK-0342 and attacked the truck driver, Rajkamal, and security in-charge Puran Singh and Azad Khan, with the intent to kill them. Rajkamal, Azad Khan, and Puran Singh were injured in the incident. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and has been falsely implicated in this case. She further submits that the poor villagers including the present applicants were only invoking the fundamental right to protest peacefully against the SECL authorities for their legal right to get compensation and employments in lieu of land acquisition and that protest has been distorted poor villagers were injured and applicants were falsely implicated in the present case and they have to take legal course against the complaint and his associates. She further submits 3 that there was counter FIR Therefore, he prays for grant of anticipatory bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application of the applicants. 5. I have heard learned counsel for the parties and perused the materials available on record. 6. Considering the facts and circumstances of the case, nature and gravity of allegation leveled against the applicants, submissions made by learned counsel for the parties, at this stage without expressing any opinion on merits, this Court is of the view that the applicants are entitled to be granted anticipatory bail in this case. 7. Accordingly, the instant MCRCA is allowed and it is directed that in the event of arrest of the applicants Praveen Dubey, Somar Sai, Baban Yadav and Gorelal on executing a personal bond with one surety each in the like sum to the satisfaction of the arresting Officer, they shall be released on bail on the following conditions:- (a) The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade them from disclosing such fact to the Court. (b) The Applicant shall not act in any manner which will be prejudicial to fair and expeditious trial. (c) The Applicant shall appear before the trial Court on each and every date given to them by the said Court till disposal of the trial. (d)The Applicant and the surety shall submit a copy of their adhaar card alongwith a colored postcard full size photo having printed the adhaar number on it, which shall be verified by the trial Court.
