IN THE HIGH COURT OF ORISSA AT CUTTACK WP(C) No.16395 of 2026 Swapnarani Tripathy …. Petitioner Mr. S.R. Pati, Adv. -Versus- State of Odisha & others …. Opp. Parties Mrs. Suman Pattanayak, AGA CORAM: JUSTICE KRISHNA S. DIXIT JUSTICE CHITTARANJAN DASH Order No. 01. ORDER 25.06.2026 Challenge by the borrower is to the coercive proceedings of recovery, the present outstanding amount approximating to Rs.29,00,000/- (Rupees twenty-nine lakh) only, the principal having been shown in a sum of Rs. 11,86,000/- (Rupees eleven lakh eighty-six thousand) only long ago. 2. Learned counsel for the Petitioner submits that his client had some difficulty, inasmuch as the jurisdictional authority did not favour the claim for grant of subsidy and therefore, she was not able to repay the loans in time. He further submits that she is ready and willing to pay some reasonable amount to show the bona fide and that she will be hopefully paying the entire money back with interest accruing due if reasonable period is granted. 3. Having heard learned counsel for the Petitioner and having perused the Petition papers, we are convinced that a prima facie case is made out for issuance of emergent notice and also some reprieve subject to the condition that the Petitioner shall pay 30% of the outstanding amount in three equalized fortnightly installments. In the above circumstances, the following order is made: i) Petitioner shall pay 10% within two weeks, ii) another 10% within next two weeks following; and iii) remainder 10% in remaining two weeks; failing which not only the interim order stands vacated on its own but petition itself runs the risk of dismissal. Web copy of this order to be acted upon by all concerned. (Krishna S. Dixit) Judge (Chittaranjan Dash) Judge Prasant
