GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue a writ, order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of 2nd respondent at the instance of 3rd respondent in insisting me to vacate from house admeasuring 145-1/4 sq. yards. Covered by D.No. 8-22 in RS.No. 261- 1, situated at Balabhadrapuram Village, Biccavole Mandal, East Godavari District, as illegal, irregular, irrational, without any authority of law and violative of Articles 14 and 21 of the Constitution of India and consequently direct the 2nd respondent not to interfere in any manner with our personal liberty, aforesaid house property and civil matters…” 2. Heard the learned counsel for Petitioners and learned Assistant Government Pleader. 3. Mr. Panguluru Rachana, learned counsel for the Petitioners, submits that at the behest of Respondent No.3, Respondent No.2 is insisting the Petitioner to vacate his house without any authority of law. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that upon receipt of the complaint from Respondent No.3, the same was duly entered, and as part of the enquiry, Respondent 3 No.2 only requested the Petitioners to appear before the Police Station. It is further submitted that Respondent No.2 has not interfered in any civil disputes between the parties and has not compelled the Petitioners to vacate the house. 5. Having regard to the facts and circumstances of the case, and upon recording the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of directing the Respondent Police not to interfere henceforth in the civil dispute between the Petitioners and Respondent No.3, without following the due process of law. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
