KAMAL ORAL ORDER The petitioner claiming to be in possession of land measuring 1 acre in Sy. No.52 situated at Pillahalli Village, Dasanapura Hobli, Bengaluru North Taluk, which has been utilized by respondent No.2 for the purpose of constructing APMC Mega Market (Market Yard), is before this Court seeking following reliefs; "WHEREFORE, the petitioner respectfully prays that this Hon'ble Court be pleased to issue a writ or any other appropriate writ or direction as the case may be and be pleased to:- - 3 - HC-KAR NC: 2026:KHC:29183 WP No. 8990 of 2026 a) Issue a writ in the nature of mandamus directing the Respondent No.2 to consider the representation of the petitioner dated 31.01.2026 vide Annexure-E. b) Grant such other reliefs as this Hon'ble Court may deem to be grant in the circumstances of the case, in the interest of justice and equity." 2. Learned counsel for the petitioner submits that the said land was originally granted in favour of petitioner’s father Sri.Bettadarayappa, under the Karnataka Land Grant Rules, 1969, who passed away on 01.07.2007, leaving behind petitioner and other family members. The petitioner is continuing in possession of the said land. It is further submitted that without initiating any acquisition proceedings and without granting any compensation, respondents Authorities cannot utilize the said land. Hence, he sought for a direction to respondent No.2 to consider representation dated 31.01.2026, as per Annexure-E. - 4 - HC-KAR NC: 2026:KHC:29183 WP No. 8990 of 2026 3. In response, learned counsel for respondent No.2, drawing attention of this Court to Annexure-R3 enclosed to the statement of objections, submits that the grant, which was earlier made in favour of the father of the petitioner, was cancelled on the ground of violation of the grant conditions, as he had alienated the said land during the prohibitory period. Pursuant to the said proceedings, name of the Grantee i.e., the father of the petitioner is directed to be deleted from the revenue records vide order dated 21.02.1997 by the Special Deputy Commissioner, Bangalore District, Bangalore in the proceedings No.NU.RRT.CR.251/95-96. He submits that the petitioner does not have any semblance of right over the said land and as such, representation is being filed by the petitioner cannot be considered. He further submits that the present petition is filed after lapse of 18 years from the date of the said order passed by the Special Deputy Commissioner. 4. In response, learned counsel for the petitioner submits that petitioner was not aware of the said order - 5 - HC-KAR NC: 2026:KHC:29183 WP No. 8990 of 2026 until filing of the statement of objections by the respondents. He, therefore, submits that petitioner may be reserved with liberty to challenge the aforesaid order as permissible under law. 5. Placing his submissions on record, the petition stands disposed off.
