I have heard the submissions of the learned counsel for the petitioner as well as the learned counsel representing the State. 2. It is submitted by the learned advocate for the petitioner that the petitioner is neither the driver nor the owner and was a khalashi and he was in the vehicle and whatever has been recovered was not in his conscious possession and he has been framed in this case. 3. The prosecution raises objection and submits that huge quantity of phensedyl bottles were recovered from the vehicle and from the possession of both the driver and the khalashi. 4. Having heard the submission and on careful perusal of the entire materials on record it transpires that charge has been 2 2 framed and the date is fixed for taking evidence in the month of June 2026. 5. Having heard both the learned counsel and considering huge quantities of phensedyl that have been recovered apparently from both the persons present in the vehicle at this stage, this Court is not inclined to allow the prayer only considering that he was a khalashi. 6. Accordingly, the prayer stands rejected. 7. CRM(NDPS) 1138 of 2026 is dismissed. 8. The learned Trial Court is directed to make all endeavour to expedite the hearing within the stipulated period in terms of the statute. [Chaitali Chatterjee (Das), J.]
