Petitioner has filed this contempt petition alleging willful disobedience of the order dated 08.11.2021 passed in WPC No. 388/2020, on the ground that in compliance of the said order encroachers have not been removed from the land, subject matter of the writ petition. 2. The petitioner has come forward as whistleblower although he has no personal interest. The earlier petition filed was disposed off with direction, therefore, the respondent No.2 and 3 were obliged to comply with the direction. At present there is no such information or report as to whether the order dated 19.01.2017, passed in W.P.(C) No. 141 of 2017 has been complied with or not, therefore, this petition is disposed off. The respondent No.2 and 3 are directed that in case, the order passed by this Court in W.P.(C) No. 141 of 2017 has not been complied with so far, then the same order be again taken up for compliance. The investigation as ordered in W.P.(C) No. 141 of 2017 shall be made and report be submitted within the period of four months from today. In case any encroachment is found in the government land, then the respondent No.1 and 2 shall take necessary steps to initiate proceeding for removal of illegal encroachment of the parties concerned in accordance with the law.” 3. Learned counsel for respondents submits that the direction issued by this Court in the order passed in writ petition, subject matter of the contempt, is with regard to initiation of proceeding for removal of illegal encroachment of the parties concerned, if found over the Government land. He contented that inspection was conducted and thereafter proceedings of removal have already been initiated against the encroachers, which is pending. It is also pointed out that some of the encroachers have filed writ petition before this Court pending in WPC No. 2552/2023 in which there is interim order running in their favour. 4. Learned counsel for petitioner does not dispute this submission made by learned counsel for the respondents No. 1 & 2. 5. In the aforementioned facts of the case, I am satisfied that the direction issued by this Court in WPC No. 388/2020 has been complied with as the proceedings have already been initiated against encroachers for removal of encrochment. 3 / 3 6. In above facts of the case, contempt proceedings initiated against respondents is dropped, notice issued to respondents is discharged and the contempt petition is closed.
