02/28.07.2026 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Sarawan P.S. Case No.10 of 2026, registered for the offence under Sections 126(2), 115(2), 117(2), 109(1), 351(2), 352 and 3(5)of Bhartiya Nyaya Sanhita, 2023, pending in the court of learned Sub Divisional Judicial Magistrate, Deoghar.

Learned counsel appearing for the petitioner submits that both the sides are agnates and there are case and counter case and both the sides have received injury and the altercation took place due to the land dispute. On these grounds, he submits that anticipatory bail may kindly be granted.

Learned counsel appearing for the State opposes the prayer and submits that the allegations of assault are there and pursuant to that the injury has been received by the husband of the informant.

Considering that both the sides are agnates and there are case and counter case and it has been pointed out that both the sides have received the injury, in the attending facts and circumstances, I am inclined to grant anticipatory bail to the petitioner.

Accordingly, the above-named petitioner is directed to surrender before the learned court within two weeks from today and in the event of his arrest or surrender, he shall be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Deoghar, in connection with Sarawan P.S. Case No. 10 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
