Respondent(s) 2 For Petitioner(s) : Mr. Ankur Diwan, Advocate For Respondent/State : Ms.Supriya Upasne, GA (Hon’ble Shri Justice Ravindra Kumar Agrawal) Order on Board 17/06/2026 The petitioners have preferred the present writ petition seeking a direction to the learned Appellate Court for expeditious adjudication of Miscellaneous Appeal No. 08/2025, arising out of the order rejecting their application under Order XXXIX Rules 1 and 2 CPC. The said appeal is pending before the Appellate Court since 25.01.2025 and despite lapse of considerable time, the same has not yet been decided finally. 2. Learned counsel for the petitioners submits that prolonged pendency of the appeal is causing serious prejudice to the petitioners and, therefore, an appropriate direction may be issued to the Appellate Court to decide the appeal within a stipulated time-frame. 3. I have heard learned counsel for the petitioners and perused the material available on record. 4. Considering the limited prayer made on behalf of the petitioners and taking into account that the Miscellaneous Appeal No. 08/2025 has remained pending since 25.01.2025, this Court deems it appropritate todirect the learned Appellate Court t oconsider and decide the pending appeal expeditiously. 3 5. Accordingly, the present writ petition stands disposed of with a direction to the learned Appellate Court to make an endeavour to decide Miscellaneous Appeal No. 08/2025, strictly in accordance with law, preferably within a period of four months from the next date fixed before the said court. 6. Meanwhile, the parties shall extend full cooperation in the early disposal fo the appeal and shall not seek unnecessary adjournments. The learned Appellate Court shall decide the appeal strictly in accordance with law, after affording proper opportunity of hearing to the parties. 7.
