GP FOR HOME The Court made the following: ORDER: The Writ Petition has been filed for the following relief: “…to issue any writ, order or Direction more particularly one in the nature of writ of Mandamus declaring the action of the Official Respondents more particularly the Official Respondents No.4 and 5 in regularly calling the Petitioner to come to Vedayapalem Police Station, SPS Nellore District to settle the civil dispute with the Unofficial Respondents No.6 to 8 which is pending for adjudication in O.S. No.30/2025 against the Petitioner and others before the Hon'ble I Addl. Civil Judge (Senior Division), Nellore, SPS Nellore District without any justifiable cause and threatening with dire consequences to file false cases against him due to political influence of the Unofficial Respondents No.6 to 8 is illegal, arbitrary, unjust, against the principles of natural justice and in violation of Articles 14 and 21 of the Constitution of India and direct the Official Respondents No.4 and 5 not to call the Petitioner to Vedayapalem Police Station, SPS Nellore District and not to put troubles to the Petitioner and not to file any false cases against the Petitioner and his family members …” 3 2. Heard the learned counsel for Petitioner and learned Assistant Government Pleader. 3. Mr. Srinivasa Rao Narra, learned counsel for the Petitioner, submits that Respondent Nos.4 and 5 are regularly summoning the Petitioner to Vedayapalem Police Station, SPSR Nellore District, in order to compel him to settle a civil dispute with the Respondents Nos.6 to 8, which is already pending adjudication in O.S. No.30 of 2025 before the learned I Additional Civil Judge (Senior Division), Nellore. Despite the pendency of the said civil proceedings, Respondent Nos.4 and 5, allegedly acting under the political influence of the Respondents Nos.6 to 8, are threatening the Petitioner with dire consequences and coercing him by warning of false criminal cases, thereby interfering with the due process of law. 4. Sri P. Ajay Babu, learned Assistant Government Pleader, on written instructions, submits that the Respondent Police have never summoned the Petitioner to the Police Station at any point of time, nor have they interfered in any manner in the civil dispute pending in O.S. No.30 of 2025 on the file of the learned I Additional Civil Judge (Senior Division), Nellore. He further submits that no criminal case has been registered against the Petitioner, and there has been no threat, coercion, or inducement from the side of the police as alleged. 5. Having regard to the facts and circumstances of the case, and the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of directing the Respondent Police not to interfere henceforth in the 4 civil dispute between the Petitioner and Respondent Nos.6 to 8 without following due process of law. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, Miscellaneous petitions, if any pending, shall stand closed. _________________________ DR. Y.
