ORDER 11-02-2026 Heard Mr. D. Saikia, learned counsel for the petitioner and Mr. P. Borthakur, learned Additional Public Prosecutor, for the State respondent. 2. This is an application filed under Section 483 of the BNSS, 2023, praying for grant of bail to the accused/petitioner, namely, Sri Suder Tanti, who was arrested in connection with Gingia P.S. Case No. 02/2026 registered under Sections
Page No.# 2/3 61(2)/316(2)/318(4)/3(5) of BNS, 2023. 3. Case diary received. Perused the same. 4. Mr. Saikia, learned counsel submitted that the petitioner is no way connected with the alleged offence, neither he know the co-accused person, nor he is anyway related with the recovery of the fake gold. 5. It is submitted that on the date of incident, after closing his Fair Price Shop, he was coming to Biswanath Chariali for some official work and while he was waiting near a Creta vehicle, police came and apprehended him along with two other co-accused persons. He never saw any fake gold, nor he is associated with the other co-accused persons. However, he is in custody for last 30 days and hence, considering his length of detention, he may be released on bail. 6. Mr. Borthakur, learned Addl. PP submitted in this regard that there are materials in the case diary against the present petitioner and the fake gold was recovered from the possession of the petitioner along with two other co-accused persons and the investigation is still under process. Accordingly, he raised objection and submitted that bail prayer of the petitioner may not be considered at this stage. 7. Heard the submissions made by the learned counsel for both sides, I have also perused the case diary as well as the case record and considering the materials in the case diary and the statements made by the other co-accused persons of the case, I find that the I.O. got sufficient opportunity to interrogate the petitioner, keeping him in custody and hence I find that further custodial interrogation of the petitioner may not be required for the purpose of investigation of the case and therefore, I find it a fit case to grant the petitioner the privilege of bail. 8. Accordingly, the accused/petitioner, namely, Sri Suder Tanti, be released on
Page No.# 3/3 bail in connection with Gingia P.S. Case No. 02/2026 registered under Sections 61(2)/316(2)/318(4)/3(5) of BNS, 2023, on furnishing a bond of Rs.
20,000/- (Rupees Twenty Thousand) only, with one surety of like amount to the satisfaction of the learned Chief Judicial Magistrate, Biswanath, Biswanath Chariali, subject to the following conditions:- (i) that the petitioner shall fully co-operate with the investigation of the case and shall appear before the Investigating Officer as and when required in connection with the investigation of the aforesaid P.S. Case and (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the Court or to any police officer. 9. With the above observation and direction, this bail application stands
disposed of.
10. Return the case diary herewith.
