The petitioners allege that the private respondents are raising unauthorised construction without obtaining sanctioned plan/ permission from the concerned authority. The petitioners submitted a representation before the Pradhan, Kotra Gram Panchayat on 17th April, 2025 which is yet to be considered. The petitioners seek consideration of the same. Learned counsel for the private respondents submits that the private respondents are co-sharers of the property in question by virtue of purchase. Title suit is pending between the parties. Be that as it may, since the representation submitted by the petitioners is pending consideration, the Pradhan, Kotra Gram Panchayat, being the 5th respondent herein, is directed to consider and dispose of the representation submitted by the petitioners on 17th April, 2025 within four weeks from the date of communication of this order upon affording reasonable opportunity of hearing to all concerned 2 including the petitioners and the private respondents, in accordance with law. The decision taken by the authority shall be communicated to the petitioners within a week thereof. The writ petition is thus disposed of. There shall be no order as to costs. Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
