Petitioners Mr. Manojit Debnath Mr. Subir Debnath Ms. Aatreye Mukherjee …for the Petitioners Mr. Paramananda Sharma, APP Mr. Somnath Bera ...for State Having heard the learned counsel for the petitioners as well as the prosecution and on perusal of the materials on record as well as the case diary, it is clear that investigation is complete and trial is going on. The present petitioners are in custody for more than one year and eight months and out of 29 witnesses till date only three witnesses have been examined. It further transpires that the co-accused was enlarged on bail on the ground of remote possibility of conclusion of trial. Accordingly, the prayer for bail of the petitioners is allowed. Accordingly, the petitioners namely, Sourav Kar and Dhiman Bhattacharjee shall be enlarged on bail upon furnishing a bond of Rs. 30,000/- each with two
2 sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Barrackpore and also on condition that the petitioners shall appear before the trial court on every date of hearing until further orders and shall not intimidate the witnesses and/or tamper with evidence and/or commit any cognizable offence in any manner whatsoever. In the event the petitioners fail to adhere to any of the conditions stipulated above without justifiable cause, the trial Court shall be at liberty to cancel the petitioners’ bail in accordance with law without further reference to this Court. Accordingly, CRM (M) 1347 of 2026 is disposed of. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
